In Strickland v. Davis, Gaglione represented a number of state legislators who successfully sued the former governor under the Public Records Act for disclosure of California’s power contracts with energy companies. In another high profile trial known as the CART case, a number of plaintiffs challenged the constitutionality of Proposition 10, the Tobacco Tax Initiative. Gaglione also represented Catholic Charities USA in an appeal of a Superior Court decision requiring religious institutions provide health care coverage to employees that conflicted with the church’s religious beliefs. In a published decision in the case of Markborough California Inc. v. Superior Court, Gaglione successfully represented an engineering firm seeking to uphold a limitation of liability provision in its contract. Professional Background Gaglione started his career at the University of San Diego’s Center for Criminal Justice and joined McInnis, Fitzgerald, Rees, Sharkey & McIntyre in 1986. He became a partner with the firm in 1992 after serving as a volunteer at the San Diego County District Attorney’s office in the summer of 1991. In 1997 Gaglione started his own law firm, which is now know as Gaglione Law Group. Gaglione has served as a Judge Pro Tem in small claims court and is also a Member of the AAA National Panel Neutrals and AAA Panel of Arbitrators. He has been an Adjunct Professor at Thomas Jefferson School of Law, teaching a course on Construction Defect Litigation starting in 1995. Professional Affiliations Gaglione has been a member of the San Diego County Bar Association for over 20 years and has served as Chair of the Civil Litigation section. In 2003, he was given the Service to Legal Education award by the SDCBA. Gaglione is the 2005-07 President of the Hon. William L. Todd Jr. American Inn of Court and chaired the 2006 annual joint dinner of the San Diego chapters of the American Inns of Court, which featured 9/11 Special Master Ken Feinberg. He is a founding Board member and two-time past President of the San Diego chapter of the Federalist Society. He has refined his trial lawyer skills under Gerry Spence, attending the Trial Lawyers College. Personal Affiliations Gaglione is an Officer and Board member of Pacific Intercultural Exchange, an international student exchange based in San Diego. He is also on the boards of the San Diego-Imperial Council of the Boy Scouts of America and UNICO. Personal Background Gaglione enjoys writing articles and has served as the host of the “Primerus Law Hour” and “Independent Counsel” radio shows since 1998. He has interviewed a wide variety of people including Ralph Nader, California Supreme Court Chief Justice Ronald George, Joan Embery, former Attorney General Edwin Meese, Gerry Spence, “Judge Alex” Ferrer and “American Idol” finalist Jon Peter Lewis. Gaglione plays softball and his team is the defending champion of the SDCBA co-ed softball league. He also enjoys hiking and recently completed a “rim to rim” hike from the North Rim to the South rim of the Grand Canyon.
